Given that he seems to be quite talkative these days, I cannot help but wonder why he didn&#039;t set the record straight when contacted by the Portfolio.com reporter.

Like the others, Pharmalot also ran an updated post to clarify the record. As part of that, I spoke with Berenson, who indicated the two line e-mail he received was valuable mostly because it indicated the settlement talks, which he said he&#039;d known about previously but were on hold, had restarted. The other info in the e-mail, he said, was about setting up a teleconference call. Apparently, he didn&#039;t act on the talks previously for two reasons - they had been placed on hold some time ago and the e-mail wasn&#039;t protected by off-the-record ground rules that were established earlier with sources. For what it&#039;s worth....  Meanwhile, here&#039;s what I wrote on Pharmalot....
